(1) The energy of the orbitals does not have to be close. It'll only determine how well (overlap) they mix, not if. (2) They only need to have appropriate symmetry, i.e. a shared symmetry element. Otherwise a sigma bond between a p- and s-orbital would not be possible. As well as hybridisation itself would not be possible.
